What the work covers
Instrument choice
Lease, superficies right, usufruct or purchase, with their consequences for financing.
Site assembly
Securing many plots from many owners, including co-owned and inherited land.
Access and cables
Easements for access roads, cable routes and the connection point.
Lender requirements

- Superficies. A superficies right gives the developer ownership of the structures on someone else's land, which lenders usually prefer.
- Term. The right must last for the project life, including decommissioning.
- Heirs. Plots owned by deceased persons need succession to be completed before a valid right can be granted.
- Land strategy for the site
- Template lease and superficies agreements
- Site assembly tracker and title review
Is a lease or a superficies right better for a Romanian solar park?
A superficies right is usually preferred by lenders because it gives the project company ownership of the panels and structures and can be mortgaged. A lease can work if it is long, registered and assignable.
Must land rights for energy projects be notarized?
A superficies right must be created by notarial deed. A lease does not need one, but registering it in the land book protects it against new owners.
